I would say no one who is seriously interested in shipping a product will be interested in Max3D in it's current state as it's full of holes (not only those Mark stated, btw has the topic 3d sound been covered at all?) and hasn't matured on a wide variety of hardware yet.
I suspect it will still take quite a lot of time to get it into a round, complete and reliable shape on a wide range of cards on all three platforms, maybe even with docs? It's a typical nerd release mainly for those who like to play around with engines or for the more clueless who prefer throwing around with technical phrases without understanding what they are talking about or caring if these features work properly on other people's systems but sadly nothing for those who intended to finish and ship a product. I guess your closest chance will be if you're choosing a similar gametype like Mark is after.
All in all i would sum this up as a dissapointment as it's not in a state which quite some people were hoping for, those will continue to head for other solutions. So yes, finally it arrived but in what kind of shape and with what kind of future perspective? Maybe it will be a nice product in the longrun but i doubt this for the near future, so the real release is still to come.
