I know all the articles are "sued for downloading" etc, but as far as Im aware its for the "uploading" part of the fileshareing that they are being sued for.
This is why ppl can be sued for 16K damages and the like, they are not damageing the company by getting the software, BUT rather by redistrubuting it.
