The Geometry Wars clone was taken down not because of the gameplay but because it looked just like Geometry Wars. In fact some people thought that Geometry Wars was a rip off of Grid Wars (the Blitz game). If you make a game with 2 paddles and a ball you're not infringing on their copyright necessarily. It all depends on how you approach it.
