Wouldn't this violate some privacy laws. Basically the ISP's would have to look at the traffic to see what it is you're downloading to determine if it's copyright, which really is the same as phone surveillance, which in most democratic countries requires a court order or something similar.
Secondly, most ISP's won't want to enforce this as, it costs them money to watch the traffic and they'll loose customers from it.
