Hmmm... but why should somebody even know that B3D used FMOD?
Buying B3D allows executables under the B3D license (whatever/wherever that is). Surely what you then do with that executable is up to you whether it uses FMOD or not.
B3D, as far as I can see, doesn't come with any special conditions for FMOD.
