According to Information Week, there are spoofed activation servers around which bypass the entire official activation system.

And, just like with WGA, a critical update could blacklist those servers without any warning.

SpecViewPerf (designer program, using OpenGL) 84 to 98%(!!) slower in Vista

I would wager Tom's hardware were not using decent drivers in that particular case. Shame on them if I'm right.
