I understand why you're going to do it, but I feel you might get bogged down writing the 3d asteroids game - adding extra features and such. Just start on the Elite game ASAP.
As has been mentioned before - make the gameplay complex but above all fun.
No they can't sue you for writing a space game as long as you don't use the same name or spacecraft - come up with some wacky ships like your screensaver perhaps - or maybe not that wacky. ;-)
