It is worth noting here that Sony didn't actually write the rootkit or copy protection software. A small UK-based company did that.
...Which was ran by a former Sony executive.
The convenient thing of using a 'small external company' to try little stunts like this is that you can deflect part of the blame should it blow up in your face.
