Ok Nvidia issue seems to have been sorted. I just got this reply back.

"With the latest drivers that we will be releasing soon, I am getting around 100FPS on a Geforce4 MX 420 running with a Pentium4 2.4GHz CPU so I assume the issue is fixed. If you still have customers experiencing these problems, please let us know."
